Terms of Service for Internet Advertising
This document (referred to herein as this “Agreement”) is a contract between Notarizeitbooking.com (hereinafter referred to as “us”, “we” and “our”) and the notary (“you” and “your”) for the fulfillment of your order (the Order) for listing on the website Notarizeitbooking.com (the website) and the notary’s Customer (the person or entity booking any of the notary’s services).
1. Agreement Acceptance
This Agreement consists of the Order and the Terms of Service for Internet Advertising. By executing this Agreement, you represent that you are 18 years or older and have the authority to enter into this Agreement. Only state commissioned Notary Publics and their Customers may enter into this agreement. If you do not agree with the Terms of Service, you must terminate your use of Notarizeitbooking.com.
2. Informational Purposes Only
This website and the information contained herein are for informational purposes only. The site is a directory and booking network providing information to users in need of a Notary. We do not recommend or endorse any Notary listed on the website and assume no liability for their services. We do not warrant the validity of the information nor guarantee the quality of the work product of the listed Notaries.
Special Projects and Government Contracts Clause:
In the event that NotarizeIt LLC enters into a special project or contract with a government or private entity, the parties acknowledge and agree that NotarizeIt LLC is responsible for the work performed by the notary public service related to the special project or contract. The terms and conditions of such special projects or contracts shall be outlined in a separate agreement between NotarizeIt LLC and the respective government or private entity, and such agreement shall prevail in the event of any conflict with the Terms of Service for Internet Advertising outlined herein. Notwithstanding any other provision in this Agreement, the obligations and liabilities of NotarizeIt LLC under such special projects or contracts shall be governed by the terms specified in the separate agreement entered into for that purpose.
3. Booking Terms
By booking a notary’s services, the Customer acknowledges and agrees in advance to all fees outlined in the booking. Service and price adjustments may be made on the day of service and must be agreed upon by both the notary public and their customer. The Customer expressly waives the right to pursue a chargeback on its credit card when using it as a method of payment for services completed.
4. Term of Agreement
The term of this Agreement commences on the date of execution or acceptance by placing your Order and shall continue until we have fulfilled the Internet Advertising specified in the Order for the Initial Term, subject to our right to terminate or suspend our service or remove Internet Advertising under circumstances specified in this Agreement. The Initial Term shall be the chosen subscription period in the Order. If the Notary chooses to remove their listing from the website and discontinue our services prior to the end of the Initial Term, written notice is required.
5. Responsibilities and Commission
The notary shall adhere to all notary laws of their state. All services booked through the network are subject to a 10% commission per booking.
6. Limitations of Liability
Except as expressly provided in the order, we do not make any representations, warranties, or guarantees to you. You may not resell, assign, transfer, or delegate any of your rights. We shall have the right to subcontract performance of our obligations hereunder or to assign or otherwise transfer this Agreement.
7. User ID and Password Security
The Notary and Customer are responsible for all actions taken with their User ID and password. If shared with third parties, the account owner is responsible for all actions taken. In case of password compromise, immediate action to change the password is required.
8. Indemnification
You agree to indemnify us and hold us harmless from any claims, actions, liabilities, losses, expenses, damages, and costs arising out of or in connection with this Agreement or any Internet Advertising or services requested.
9. Governing Law and Jurisdiction
All disputes arising from this agreement shall be governed by the laws of the state of Georgia. Any lawsuit shall be filed exclusively in Fulton County, Georgia, and both parties consent to the personal jurisdiction of such courts.
10. Miscellaneous
The failure of either party to enforce any rights hereunder shall not constitute a waiver of any terms or conditions. This Agreement constitutes the entire agreement between you and us and may be changed from time to time, with revised terms effective immediately after posting on our website.
